The Website is owned and operated by Naturally Sensible Solutions, LLC, doing business as Pristine Sprays ("Pristine," "Pristine Cleansing Sprays", "NSS," "we," "us," or "our").

By accessing, browsing, or using the Website, or by placing an order through the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies or terms referenced on the Website.

1. ABOUT PRISTINE SPRAYS

Pristine Sprays is a U.S.-based consumer products company offering personal care and hygiene products, including toilet paper sprays, body cleansing sprays, and related products and accessories.

Nothing in these Terms grants you any ownership interest or license in Pristine's trademarks, copyrights, patents, trade secrets, proprietary formulas, technology, Website Content, or other intellectual property except for the limited right to use the Website as expressly permitted herein.

Pristine's proprietary technology, formulas, product designs, packaging, and other intellectual property may be protected by patents, patent applications, copyrights, trademarks, trade secrets, or other rights.

Unauthorized use of Pristine's intellectual property is prohibited.

6. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to provide accurate information regarding our products, including descriptions, images, ingredients, sizes, scents, colors, packaging, availability, and other product characteristics.

8. ORDERS AND ORDER ACCEPTANCE

When you place an order through the Website, you are making an offer to purchase the products included in your order.

Your receipt of an order confirmation does not necessarily mean that Pristine has accepted your order. Pristine reserves the right to accept, decline, limit, or cancel any order, in whole or in part, for any lawful reason, including:

  • Errors in shipping or billing information;
  • Suspected fraud or unauthorized activity;
  • Payment authorization issues;
  • Quantity limitations;

If we cancel an order after payment has been received, we will issue an appropriate refund for the canceled portion of the order.

Payment Processing

Payments for purchases made through the Website are processed using Shopify's ecommerce and payment-processing services, including Shopify Payments and/or other payment methods made available through our Shopify checkout (including but not limited to PayPal, Shop App.

By submitting payment information, you authorize the applicable payment method to be charged for the total amount of your purchase, including applicable taxes, shipping charges, and other amounts disclosed at checkout.

Shopify provides the ecommerce platform and payment-processing services used by Pristine. Pristine, and not Shopify, is the seller of the products purchased through the Website and is responsible for the transaction between Pristine and the customer.

Payment processing may also involve third-party payment processors or financial institutions operating pursuant to their own terms and policies.

You are responsible for providing accurate billing and payment information and for having authorization to use the payment method submitted.

10. SHIPPING AND DELIVERY

Pristine currently sells and ships products only within the United States.

We do not currently accept orders requiring shipment outside the United States. If you submit an order with an international shipping address, we reserve the right to cancel the order and issue an appropriate refund.

Shipping options, costs, estimated delivery dates, and applicable restrictions will be presented during checkout or otherwise communicated to you.

Estimated shipping or delivery dates are estimates and are not guarantees unless expressly stated otherwise. Any estimated shipping or delivery dates are estimated by the United States Postal Service (USPS) or postal carrier; times and dates are not estimated by Pristine.

Delivery may be affected by circumstances outside Pristine's reasonable control, including carrier delays, weather, natural disasters, transportation disruptions, governmental actions, or other events beyond our reasonable control.

We will make reasonable efforts to fulfill orders within the time stated at the time of purchase. If we become unable to ship an order within the time required by applicable law, we will provide any notices, options, cancellations, or refunds required by law.

You are responsible for providing a complete and accurate shipping address.

11. RETURNS, REFUNDS, AND EXCHANGES

Pristine's current return, refund, and exchange procedures are described in our Return & Refund Policy, which is incorporated into these Terms by reference.

Any eligibility requirements, time limits, exclusions, return-shipping responsibilities, and refund procedures contained in the applicable Return & Refund Policy will apply to your purchase.

Nothing in these Terms limits any rights you may have under applicable consumer-protection laws.

12. PROMOTIONS, COUPONS, AND DISCOUNTS

Pristine may offer promotional codes, first-time customer discounts, "Spin to Win" offers, sales, bundles, free-shipping promotions, referral offers, or other promotional opportunities.

Where permitted by applicable law, this license includes the right to use User Content in connection with Pristine's Website, social media accounts, advertising, email marketing, promotional materials, and other marketing channels.

You understand that User Content may be publicly visible when posted to the Website or social media.

You should not submit confidential or proprietary information through the Website unless Pristine has specifically requested it.

Shopify's own terms and policies govern Shopify's relationship with Pristine as a merchant. Those terms do not replace these Terms or create a separate contract between you and Shopify concerning the purchase of Pristine products.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRISTINE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES RELATING TO THE WEBSITE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PRISTINE DOES NOT WARRANT THAT THE WEBSITE OR WEBSITE CONTENT WILL MEET YOUR PARTICULAR REQUIREMENTS OR EXPECTATIONS.

PRODUCTS SOLD BY PRISTINE ARE SUBJECT TO ANY EXPRESS PRODUCT WARRANTY THAT PRISTINE MAY PROVIDE, IF ANY, AND TO RIGHTS AND REMEDIES THAT CANNOT LAWFULLY BE DISCLAIMED.

20. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRISTINE AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AFFILIATES, SUCCESSORS, AND ASSIGNS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRISTINE'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE WEBSITE OR PURCHASE OF PRODUCTS FROM THE WEBSITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PRISTINE FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law, including liability that cannot lawfully be waived by contract.

21. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Pristine and its owners, members, managers, officers, directors, employees, agents, representatives, affiliates, successors, and assigns from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • Your violation of these Terms;
  • Your misuse of the Website;
  • Your violation of applicable law;
  • Your infringement or violation of another person's rights;
  • User Content submitted by you; or
  • Your fraudulent, negligent, or intentional misconduct.

This indemnification obligation does not apply to the extent a claim results from Pristine's own conduct where indemnification is prohibited by applicable law.

22. FORCE MAJEURE

Pristine will not be responsible for delay, interruption, or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic conditions, labor disruptions, transportation interruptions, supply-chain disruptions, governmental actions, war, terrorism, civil unrest, utility or telecommunications failures, cyber incidents, or failures of third-party service providers.

This provision does not relieve Pristine of any obligation to provide refunds or other remedies required by applicable law.

23. GOVERNING LAW AND DISPUTE VENUE

These Terms and any dispute arising out of or relating to these Terms, the Website, or a purchase made through the Website will be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent federal law or applicable mandatory consumer-protection law requires otherwise.

To the extent permitted by applicable law, you consent to the personal jurisdiction of the applicable courts in the selected venue.

Nothing in this section prevents a consumer from exercising a right or pursuing a claim in a forum where applicable law requires that the claim be heard.

24. SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in full force and effect.

25. NO WAIVER

Pristine's failure to enforce any provision of these Terms does not constitute a waiver of that provision or Pristine's right to enforce it in the future.

26. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without Pristine's prior written consent.

Pristine may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, corporate reorganization, financing, or other business transaction, or as otherwise permitted by law.

27. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Return & Refund Policy, Shipping Policy, and any other policies or terms expressly incorporated by reference, constitute the entire agreement between you and Pristine concerning your use of the Website and supersede prior or contemporaneous understandings relating to the same subject matter.

Additional terms may apply to particular products, promotions, services, or transactions and will be provided where applicable.
